1. Acceptance of Terms

By accessing or using the Sela mobile application and related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Sela ("we," "our," or "us").

2. Eligibility

You must be at least 13 years old to use Sela. By using the Service, you represent that you meet this minimum age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information.
  • Maintain the security of your account credentials.
  • Promptly notify us of any unauthorized access to your account.
  • Accept responsibility for all activity that occurs under your account.

4. Use of the Service

Sela grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes, subject to these Terms.

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Record or upload content that infringes on the rights of others.
  • Attempt to reverse engineer, decompile, or disassemble any part of the Service.
  • Interfere with or disrupt the Service or its underlying infrastructure.
  • Use automated systems or bots to access the Service.
  • Share your account credentials with others or allow others to use your account.
  • Use the Service to harass, threaten, or harm others.

5. Your Content

You retain ownership of all content you create through the Service, including voice recordings, and any associated metadata ("Your Content").

By using the Service, you grant us a limited license to process, store, and analyze Your Content solely for the purpose of providing and improving the Service. This includes transcription, AI-powered analysis, and location-based features.

We will not sell, share, or use Your Content for advertising purposes. Your Content is processed according to our Privacy Policy.

6. AI-Generated Content

Sela uses artificial intelligence to generate transcriptions, mood analysis, summaries, and other insights from your voice recordings. You acknowledge that:

  • AI-generated content may not always be accurate or complete.
  • AI analysis is provided for personal reflection purposes and should not be relied upon as professional advice (medical, psychological, legal, or otherwise).
  • Mood scores and activity detection are approximations and may not reflect your actual state.

7. Location Services

Core features of Sela rely on location data. By enabling location services, you consent to the collection and use of your geographic coordinates as described in our Privacy Policy. You may disable location services at any time through your device settings, though this will limit certain features.

8. Subscription and Payments

Sela may offer free and paid subscription tiers. If you purchase a subscription:

  • Payment will be charged to your Apple ID account at confirmation of purchase.
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
  • You can manage and cancel subscriptions in your device's account settings.
  • Refunds are subject to the Apple App Store refund policy.

9. Intellectual Property

The Service, including its design, features, code, and branding (excluding Your Content), is owned by Sela and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We are not responsible for any loss of data, including voice recordings or associated content.

Sela is not a substitute for professional mental health, medical, or therapeutic services. If you are experiencing a crisis, please contact a qualified professional or emergency services.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SELA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Sela, its founders, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. You may delete your account at any time through the app. Upon termination, your right to use the Service ceases immediately, and we will delete your data in accordance with our Privacy Policy.

14. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes through the app or via email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in California.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
